Open houses move fast in New York, and navigating them smoothly, whether you're touring or hosting, requires a mix of good etiquette, smart strategy, and legal awareness. Here's a practical guide for both sides in today's market.

For Buyers

1. Know Your Representation Status Before Walking In
   • Touring with your agent? Make sure you've executed your Written Buyer Representation Agreement beforehand, as required by current real estate regulations. Touring alone? You can attend open houses unrepresented. Expect the listing agent to ask you to sign in and review the required NY State Agency Disclosure Form, confirming that they represent the seller's financial interests.
2. Arrive Prepared with Proof of Funds
   • Bring a digital copy of your pre-approval letter or proof of funds. In a fast-paced NYC market, showing listing agents that you are a qualified buyer instantly elevates your credibility if you decide to make an offer.
3. Ask the Right Questions, and Save Due Diligence for Later
   • It's great to ask about recent building upgrades, monthly maintenance or common charges, or whether the seller is open to purchase concessions, such as buyer-broker fee coverage. However, deep-dive due diligence, reviewing board meeting minutes, alteration agreements, and financial statements, is best handled by your agent and attorney after the tour.
4. Protect Your Negotiating Position
   • Be courteous and complimentary, but avoid revealing your maximum budget or timeline pressure to the listing agent. Anything you share can be relayed to the seller to calibrate their leverage.

For Sellers

1. Clear Building Logistics First
   • NYC co-ops and condos have strict rules regarding open houses. Coordinate with your managing agent and doorman or building staff early to clear visitor access, schedule elevator availability, and ensure building guidelines are followed.
2. Prepare for Commission and Concession Inquiries
   • Today's buyers and their agents will evaluate total transaction costs during the tour. Decide upfront with your listing agent how you plan to handle buyer concession requests so your agent can communicate a clear, inviting strategy to prospective buyers.
3. Plan to Be Elsewhere
   • Sellers should always leave the apartment during open houses. Buyers speak far more candidly, spend more time taking in the space, and test layout flow more comfortably when the owner isn't present.
4. Maintain Peak Presentation and Gather Data
   • Every visitor deserves the same experience, whether it's your first open house or your fourth. Keep the space immaculately staged, well-lit, and decluttered. Afterward, review visitor feedback and digital sign-in logs with your agent to identify patterns in pricing, layout perception, or building charge feedback.

The Bottom Line

Open houses in New York are fast and competitive, but proper preparation, and a clear understanding of today's agency disclosure and representation requirements, makes the process smooth and productive for everyone involved.
